Compliance and Litigation Counsel Overview: To further assist our Legal Department, we are looking for a Data Privacy and Retention Counsel to advise the Company on all applicable federal, state and local laws, rules and regulations affecting its operations and businesses. In this role, you will be responsible for matters ranging from analysis of laws and regulations applicable to a technology company with domestic and international operations as well as analysis of applicable laws and regulations that apply to our customers. Our Legal Department takes an active role in guiding the direction and structure of our strategic initiatives and commercial arrangements. Additionally, because we offer software and SaaS solutions to businesses operating in a highly regulated and rapidly evolving industry, there is a constant need to ensure our products and services continue to evolve with the legal landscape. Accordingly, we are seeking a highly motivated self-starter with good business judgment who enjoys working in a dynamic, fast-paced and collaborative environment. In this challenging position, you will report to our Senior Compliance Counsel and our General Counsel and work closely with key executives, advising on an array of legal issues. Simply put, we are seeking a motivated attorney to help a rapidly growing company execute its business plan. The impact you'll make: Provide advice and counsel to the Company on a wide range of compliance-related matters, including marijuana-related laws, advertising laws, data privacy and security laws, procurement and international sourcing laws, political laws, employment laws and general corporate compliance issues. Provide advice and counsel to the Company and product team regarding new product offerings and functionalities in light of applicable laws. Work with our Senior Compliance Counsel, our General Counsel and other Company stakeholders in the development of policies and procedures and specialized training programs designed to prevent illegal, unethical or improper conduct. Work to develop SOPs and other procedure guides to ensure departmental compliance as well as establishing periodic audits of adherence to these procedures. Identify potential areas of compliance vulnerability and risk, and develop and implement corrective action plans for resolution of problematic issues. Conduct research regarding legal and compliance issues affecting the Company's businesses, translating complex laws and regulations into practical advice and solutions. Provide advice and counsel to the Company on all matters relating to data privacy and security, including data of users, consumers, employees and third-parties, data privacy requirements for websites, social media, apps, connected products, e-commerce, customer relationship management and the Company's various products and services, and all laws relating to data privacy and security in the various jurisdictions in which the Company operates, including the US, Canada and the EU. Draft, review and revise data privacy and security-related provisions in the Company's various commercial contracts. Work closely with IT, Tech, Product and other Company stakeholders regarding general compliance matters. Work with our Senior Compliance Counsel and General Counsel to oversee Company litigation matters. What you've accomplished: JD from a top law school Active member of a state bar in good standing; preference for admittance to the California bar in good standing. Experience: Three to seven years of experience as an attorney in a law firm or corporate legal department required (or equivalent experience in nonprofit or public sector); experience handling compliance-related matters is preferred. Experience in one or more of data privacy and security laws, securities law or employment law is required. Litigation experience is required.. Knowledge, Skills, and Abilities: Highly self-motivated and able to work independently with minimal supervision. Ability and willingness to develop expertise in other regulatory areas to meet needs of our dynamic business. Must possess strong analytical, drafting and negotiation skills, as well as excellent oral and written communication skills and judgment. Able to think creatively to find practical solutions to complex issues. Organized and detail oriented. Able to effectively prioritize and manage multiple matters. Sophisticated interpersonal skills, including the ability to develop strong internal relationships, influence others, and work as part of cross-functional teams and in partnership with team members at all levels of the organization. Able to manage and oversee outside counsel and internal attorneys, paralegals, business associates and other team members. Passion for startups and technology.
